Commentary by Attorney Michael Grossman
If these allegations are true, then it would seem authorities are taking steps to see the alleged intoxicated driver answers for what happened here. However, there could be more to the story. Arkansas, like Texas, has laws regarding drunk driving accidents whenever that alcohol unlawfully came from a local alcohol provider. If investigations show that a bar, corner store, or some similar establishment unlawfully served the alleged drunk driver, the alcohol provider may be responsible for contributing to the ensuing accident.
I've handled hundreds of alcohol-related accident cases. Frankly, these potential legal avenues go overlooked all the time. Authorities put all of their focus on a single reckless individual—one who absolutely deserves attention. Meanwhile, though, there could be a local establishment who contributed to someone's death continuing to put lives at risk. Shouldn't they, too, face appropriate consequences?
That's why experience makes me wonder if investigations are being thorough enough here to make sure the victims and families are going to see the just conclusion they deserve to see.
