Commentary by Attorney Michael Grossman
When I see a report about someone being seriously injured while simply stopped at an intersection—especially when the crash involves a driver allegedly fleeing police under the influence—it highlights just how far the consequences of drunk driving can reach. Marisela Rosales was reportedly doing nothing more than waiting at a light. If the reports are accurate, what followed wasn’t just a matter of reckless driving—it may have begun much earlier in the evening, with someone serving alcohol to a person who was already past the point of control.
That’s the question dram shop law in Texas is designed to help answer: Where was this person drinking, and should someone have stopped serving him? If a bar, restaurant, or other alcohol provider served this driver when he was already clearly intoxicated, that establishment may share responsibility for what happened next. It’s not about removing blame from the driver—it’s about recognizing when others may have contributed to a dangerous and preventable situation.
When drunk driving crashes involve high-speed chases, police response, and serious injuries to innocent people, the focus often lands on the chaos of the moment. But for those affected, like Ms. Rosales, the bigger picture may be just as important: How did this person get behind the wheel in the first place—and who helped put him there?
Three key takeaways:
- Texas dram shop law allows injured parties to hold alcohol providers accountable if they serve someone who is clearly intoxicated and that person causes harm.
- Crashes involving fleeing suspects and suspected impairment often begin hours earlier—at the place where the drinking occurred.
- Victims may have legal options beyond the driver, including the right to investigate whether a bar or restaurant contributed to the events leading up to the crash.
