Commentary by Attorney Michael Grossman
When a single-vehicle crash results in someone being ejected, it naturally raises concerns about what really caused the vehicle to veer off course. These types of incidents often seem straightforward at first glance, but a closer look can reveal much more beneath the surface.
1. Did the authorities thoroughly investigate the crash?
The official explanation points to a loss of control and over-correction, but it’s important to ask whether that conclusion was based on a detailed reconstruction or just a surface-level assessment. Proper investigation should involve mapping the crash trajectory, examining road markings, and evaluating the vehicle's path through the median. Without that level of scrutiny, it’s hard to be sure what actually caused the driver to lose control in the first place—or how the vehicle responded afterward.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
Whenever a vehicle swerves suddenly and rolls over, mechanical failure must be on the table. A malfunction in the steering system, a locked wheel, or an unexpected shift in the suspension could all explain the sudden deviation. Since no other vehicles were involved, mechanical issues may be even more relevant here. If a defect was at play, it’s unlikely to be obvious without a professional teardown and inspection of the Sierra.
3. Has all the electronic data relating to the crash been collected?
Modern trucks like the Sierra often store vital pre-crash data. That includes whether the brakes were applied, steering inputs, and the speed at the moment of control loss. Combined with any GPS or mobile phone records, this data can clarify whether the driver made a sudden move, hesitated, or reacted to something unexpected. If no one retrieves that information early, it could be lost permanently.
Events like this should never be accepted at face value without digging into all the possibilities. A complete picture doesn’t emerge from assumptions—it comes from asking the right questions and following the data wherever it leads.
Takeaways:
- Loss of control should be verified with scene reconstruction, not assumed.
- Single-vehicle rollovers demand a check for possible mechanical defects.
- Onboard electronics often hold the key to understanding how a crash unfolded.
