Commentary by Attorney Michael Grossman
When I read about a crash like this, my first thought is that I hope those affected receive the answers they need. While it may seem like a straightforward case of a vehicle losing control, my experience has shown that crashes often have more to them than meets the eye. Before drawing any conclusions, it’s essential to ask three key questions to ensure a full and thorough investigation.
The first question is whether authorities conducted a comprehensive investigation. Law enforcement officers typically document crash scenes, take witness statements, and assess visible evidence. However, the depth of these investigations can vary depending on resources and training. In single-vehicle crashes, it’s common for driver error to be assumed as the cause, but without considering all factors—such as road hazards, mechanical failures, or even the possibility of another vehicle’s involvement—important details could be missed. A full investigation should explore whether factors like poor road maintenance, debris, or other external elements played a role.
The second question—one that is too often overlooked—is whether a vehicle defect contributed to the crash. Pickup trucks, like all vehicles, rely on complex mechanical systems that must function properly to maintain control. Sudden brake failures, steering malfunctions, or stability control issues can cause a driver to lose control, especially at highway speeds. Additionally, rollovers in certain truck models raise concerns about structural integrity and crashworthiness. However, identifying a defect requires a thorough forensic examination of the vehicle, and if it is not preserved for inspection, crucial evidence could be lost.
The third question is whether all available electronic data has been collected. Most modern vehicles are equipped with an electronic control module (ECM), which records key information such as speed, braking, and steering input leading up to the crash. Additionally, nearby surveillance footage, dashcam recordings, or even cell phone data from the driver could provide valuable insight into what happened in those critical moments before the crash. This data is time-sensitive, and if it isn’t secured quickly, it could be lost or overwritten.
At the end of the day, answering these three questions isn’t just about understanding how this crash happened—it’s about ensuring that those affected by it have access to the full truth. Serious crashes leave families searching for clarity, and the least we can do as a community is make sure every potential factor is examined before conclusions are reached.
