Commentary by Attorney Michael Grossman
When a pickup leaves the road and hits a fixed object, it’s tempting to assume the driver simply made a mistake. But a single-vehicle crash that results in serious injuries deserves more than guesswork. Without a thorough investigation, key factors may be missed entirely.
1. Did the authorities thoroughly investigate the crash?
When a truck strikes a fence, the central question becomes: how and why did it leave the roadway? Was speed involved, or did the vehicle swerve to avoid something? Investigators should have documented the full scene—tire marks, damage patterns, vehicle trajectory—and determined whether the driver attempted to brake or steer before impact. If that level of analysis wasn’t done, the cause remains unclear.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
A mechanical failure could have played a direct role. If the Dodge Ram experienced brake loss, a steering issue, or tire separation, that could explain the sudden departure from the road. Pickup trucks also carry a higher rollover risk, depending on how they’re loaded or equipped. Without a post-crash inspection of the vehicle, mechanical factors may go unnoticed.
3. Has all the electronic data relating to the crash been collected?
Modern trucks typically record data on speed, throttle, braking, and steering inputs—information that can clarify what the driver was doing in the moments before the crash. GPS logs and phone usage data may also help determine whether distraction or route decisions played a role. This kind of information often fades quickly unless secured early.
Single-vehicle crashes shouldn’t be treated as foregone conclusions. Serious injuries mean something went wrong—and that warrants a full accounting of all possible causes.
Takeaways:
- Full scene analysis is necessary to understand why a single-vehicle crash occurred.
- A mechanical failure in the truck could have caused or worsened the loss of control.
- Electronic and GPS data may provide key insights into the vehicle’s movement and driver behavior.
