Commentary by Attorney Michael Grossman
When a passenger vehicle becomes wedged beneath the trailer of an 18-wheeler, the key question isn’t just what happened, but why it happened. In my experience handling truck accident cases, wrecks like this rarely occur without multiple contributing factors that need to be examined.
How did the sedan end up under the trailer? Underride collisions typically happen when a truck is crossing or turning across traffic, stopping suddenly, or if a smaller vehicle fails to notice the truck in time. Investigators should review dashcam footage, black box data, and witness statements to determine what led to the impact.
Was the truck’s trailer properly marked? Federal regulations require trailers to have reflective markings and underride guards to prevent smaller vehicles from sliding underneath. If these safety features were missing, defective, or poorly maintained, that could have played a role in the severity of the crash. Investigators should examine inspection records, crash scene photos, and vehicle design specifications to determine whether proper safeguards were in place.
Did speed or driver error contribute? The positioning of the vehicles suggests a potential turn or lane change by the truck, or that the sedan may not have had enough time to react. Investigators should analyze speed data, braking distances, and roadway design to determine whether either driver failed to adjust for conditions.
Did the trucking company play a role? Trucking companies are responsible for ensuring their vehicles meet safety regulations and that their drivers are properly trained to operate in high-traffic areas. If this driver was inexperienced, under pressure to meet unrealistic deadlines, or operating a truck without proper safety equipment, investigators need to uncover those details. Reviewing company policies, training records, and past violations could provide insight into whether broader issues contributed to the crash.
At the end of the day, the most important thing is finding answers. Even if it takes an independent investigation to gather the right evidence, it’s critical to examine every factor to ensure those affected by the crash get the clarity they deserve.
