Commentary by Attorney Michael Grossman
A crash like this makes me think of all of the questions that the people on the trolley and their loved ones must have. Authorities have told us what happened, a driver apparently overcorrected after veering off the road, but we still don't know why. To put it bluntly, there are still a lot of unanswered questions about this crash.
This may sound a bit odd, but commercial vehicle crash investigations must go beyond the site of the accident to gather the all the information necessary to get a full picture of what happened and why it happened. Just saying a bus went off the road does not explain that. It doesn't answer a whole host of questions like: What kind of training did the bus operator receive? Were there any issues with drivers that went unaddressed before this incident? How was the vehicle maintained prior to the crash? Were their warning signs that went ignored? Could procedures put in place by the bus operator have contributed to this crash? And there are probably dozens of other unanswered questions beyond those.
At the end of the day, I have worked with accident victims long enough to know that what they want most are answers and accountability. I think we all agree, when all is said and done, that's the least they deserve.
