Commentary by Attorney Michael Grossman
When a motorcycle crash results in serious injuries to a passenger, like the one reported on Interstate Highway 20, the natural assumption is often that the driver lost control due to speed, inattention, or rider error. But as someone who has spent more than 30 years examining crashes like this one, I know that getting to the truth requires asking deeper questions—questions that are too often overlooked.
First, did law enforcement conduct a complete and thorough investigation? It’s essential that authorities document more than just the final resting place of the motorcycle. Did they analyze skid marks, scrape patterns, or roadway debris that might indicate what led the motorcycle to veer off course? Were they able to interview both the driver and the passenger while memories were still fresh? Too often, investigations into single-vehicle motorcycle accidents fail to capture the full context.
Second, has anyone considered the possibility that a defect in the motorcycle contributed to the loss of control? Motorcycles are especially sensitive to issues like brake failure, steering lock-up, or tire delamination. If a mechanical issue caused the driver to lose control, the manufacturer or a maintenance provider may bear responsibility—but such issues can go undetected if no one bothers to look for them.
And finally, has all relevant electronic data been collected and preserved? While motorcycles may not store as much electronic information as modern cars, some models are equipped with data recorders that capture speed, lean angle, and brake usage. Moreover, traffic or dash cameras from nearby vehicles could provide crucial evidence of how the crash happened—if someone takes the initiative to locate it.
Answering these three questions is critical to making sure that no stone is left unturned in understanding the causes of a crash like this. Serious wrecks deserve serious investigation, not assumptions. Getting clear answers to these questions is crucial for those seeking to understand what happened and why—and it's the least that can be done to help those affected find the clarity and closure they deserve.
