Commentary by Attorney Michael Grossman
When multiple vehicles are involved in a chain-reaction crash, the first reports often focus on who struck who. But real answers usually require a closer look at how the entire sequence unfolded.
Did the authorities thoroughly investigate the crash?
Multi-car accidents can be complex, yet not every department has the tools, training, or time to fully reconstruct them. A proper review should map the scene, evaluate damage patterns across all vehicles, and establish the timing of each impact. Without that, responsibility may be oversimplified or misunderstood.
Has anyone looked into the possibility that a vehicle defect caused the crash?
While investigators pointed to one driver failing to control speed, it’s important not to rule out mechanical failures too soon. Brake or tire issues could explain why a vehicle didn’t stop in time. On top of that, failures in airbags or seatbelts can worsen injuries, even when a crash should have been survivable.
Has all the electronic data relating to the crash been collected?
Each vehicle’s Engine Control Module (ECM) may provide key data like speed, throttle, and braking input just before impact. Combined with cellphone records and any available traffic camera footage, this evidence can clarify how the crash actually unfolded. This information is highly time-sensitive and should be preserved quickly.
In collisions involving multiple vehicles, the difference between speculation and a clear account comes down to whether investigators secure and analyze all of the available evidence. Victims and families need to have as much evidence working in their favor as possible to get a just resolution.
Takeaways:
- Multi-car crashes require careful reconstruction to establish the full sequence.
- Vehicle or safety system defects can contribute to both cause and injury severity.
- ECM data, cameras, and cellphone records are essential to confirm the facts.
