Commentary by Attorney Michael Grossman
I get calls about single-vehicle wrecks all the time. Naturally, people want to be sure their situation is in good hands. A lot of people, though, end up relying on the authorities only to end up with what they feel are incomplete reports or details that are just focusing on finding blame rather than getting the whole story. It's one of the reasons I've always discussed the importance of following up with authorities early on in their investigations.
For example, did investigators take the time to examine all potential contributing factors? While many assume single-vehicle crashes are straightforward, external issues like road hazards, road design flaws, or even other drivers' actions can play a role. A thorough investigation should explore these possibilities rather than jumping to conclusions.
Did authorities check for possible defects or malfunctions in the vehicle? Problems with brakes, steering, or even faulty safety features can impact the severity of a crash. Without a proper inspection, there's no way to rule out whether these issues played a role.
Was all available electronic data collected? Many modern vehicles have event data recorders that can reveal crucial details about speed, braking, and steering inputs before a crash. Additionally, surveillance footage or phone records may provide further context. If authorities didn’t secure this evidence quickly, it may no longer be available.
If authorities can't provide clear answers to these questions, it may be because they didn't really give the crash the attention it deserves. If they can, then perhaps authorities were able to get all the important details. At the end of the day, these questions can help people decide if they'd feel more comfortable having independent professionals take a second look at the crash. That way, they can know nothing important slipped through the cracks.
