Commentary by Attorney Michael Grossman
Moments of calm can shatter in an instant, often without any clear reason. One moment everything is routine, and the next, someone is seriously hurt. It's during these moments that the facts matter most; both the ones we know and the ones that might have been missed.
Did the authorities thoroughly investigate the crash? When a moving vehicle strikes a parked one, people tend to assume it’s a simple matter of driver error. But even seemingly clear-cut cases deserve a complete look. That means more than writing a quick report. It calls for mapping the scene, retracing vehicle paths and understanding what the driver was doing just before impact. Some departments are excellent at this level of detail. Others may lack the tools or time, especially late at night. Without a thorough reconstruction, important factors can slip through the cracks.
Has anyone looked into the possibility that a vehicle defect caused the crash? A crash involving a stationary vehicle raises an obvious question: why didn’t the driver stop in time? If the brakes didn’t engage properly, if the steering locked up or if a sensor failed to warn the driver, those could point to a mechanical issue, not human error. Late-model vehicles aren’t immune to defects. A close mechanical inspection could reveal if something under the hood contributed to what happened.
Has all the electronic data relating to the crash been collected? Modern vehicles can tell us a lot: how fast someone was going, when brakes were applied or whether the driver was distracted. That’s assuming someone takes the time to pull the data. Without it, we’re relying on memory and assumptions. In a case like this, electronic records might make the difference between guessing and knowing.
As always, the deeper truth of any crash isn’t found in surface details. It’s in the effort to ask better questions and follow the answers wherever they lead.
Key Takeaways:
- Not all crash investigations are thorough. Some stop at surface-level observations.
- Mechanical issues like brake failure or steering problems need to be ruled out.
- Vehicle data can confirm or challenge assumptions about what really happened.
